Rules and Regulations


Virtually all state government agencies issue rules and regulations of some kind. Most rules and regulations exist at the direction of the state legislature in order to regulate certain business and personal activities. Rules and regulations exist because it’s easier to update them, eliminate them, or alter them administratively than it is to pass new legislation each year as conditions change.

The process of reviewing and changing rules and regulations is a public one. The rules and regulations issued by the Colorado Department of Public Safety are shown here so that you may know about the process and can comment on how they could affect you or your business. Rulemaking Announced by Colorado State Patrol

HM Routing Rules, Motor Carrier Safety Rules, and Port of Entry Rules

The Colorado State Patrol has announced a rulemaking process regarding three sets of administrative rules. The public hearing will be held on Wesneday, February 5, 2020 at the Colorado State Patrol Academy in Golden. 8 CCR 1507-25, the "Rules and Regulations Concerning the Permitting, Routing & Transportation of Hazardous and Nuclear Materials and the Intrastate Transportation of Agricultural Products in the State of Colorado," also known as the "HM Routing Rules."  

The Colorado State Patrol Hazardous Materials Section is proposing changes to the HM Routing Rules updating references to state and federal regulations, Out-of-Service Criteria, and to the Emergency Response Guidebook; to expound in greater detail upon existing and previously adopted federal regulations impacting the routing factors that must be addressed by petitioning authorities submitting hazardous materials routing applications for new or existing routes; and to clarify the requirements applicable to law enforcement officers performing commercial vehicle inspections. Other changes being proposed address minor grammar, formatting and update website address information. 
 
8 CCR 1507-25, the "Rules and Regulations Concerning Minimum Standards for the Operation of Commercial Vehicles,” also known as the “Motor Carrier Safety Rules.” 
 
The CSP Motor Carrier Safety Section is proposing changes to the rules clarifying the applicability of these rules to vehicles supporting snowplowing operations and the inapplicability of the financial responsibility (insurance) requirements of these rules to vehicles operated by river outfitters regulated by the Colorado Department of Natural Resources, Division of Wildlife; incorporating the most recent Out-Of-Service Criteria set forth by the Commercial Vehicle Safety Alliance (CVSA); updating reference to the October 2019 Federal Motor Carrier Safety Regulation, incorporated documents and other agencies; and addressing minor grammar and formatting items.  

8 CCR 1507-28, the "Port of Entry Rules for Commercial Motor Carrier Size, Weight and Clearance,” also known as the “POE Rules.”  

The CSP Port of Entry Branch is proposing changes to the rules to ensure compliance and consistency with state law and federal regulations.  Specific amendments address and clarify wheel and axle weight information as it relates to specified single drive axle vehicles and reference to maximum height allowances for all vehicles; update provisions relevant to the Special Revocable Permit Program regarding the processing of applications; and edit existing email and physical address information.  Also addressed are any minor grammar or formatting items existing in the present rule.
