Definitions

Colorado Clean Indoor Air Act
Section 25-14-203 of the Colorado Revised Statutes, which seeks to “preserve and improve the health, comfort, and environment of the people of this state by limiting exposure to tobacco and marijuana smoke.”
 
Driving under the influence
Having 5 nanograms or more of delta 9-tetrahydrocannabinol (known as THC) per milliliter in whole blood (CRS 42-4-1301).
 
Enclosed
A permanent or semi-permanent area covered and surrounded on all sides. Temporary opening of windows or doors or the temporary removal of wall or ceiling panels does not convert the area into an unenclosed space. (Colorado Revised Statutes Section 18-18-102)
 
Locked space
Means to be secured at all points of ingress or egress with a locking mechanism designed to limit access such as with a key or combination lock. (Colorado Revised Statutes Section 18-18-102)
 
Marijuana
"All parts of the plant of the genus cannabis whether growing or not, the seeds thereof, the resin extracted from any part of the plant, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or its resin, including marijhuana concentrate. ‘Marijuana’ or ‘marihuana’ does not include industrial hemp, nor does it include fiber produced from the stalks, oil, or cake made from the seeds of the plant, sterilized seed of the plant which is incapable of germination, or the weight of any other ingredient combined with marijuana to prepare topical or oral administrations, food, drink, or other product.” (Colo. Const. Art. XVIII, Section 16)
 
Medical marijuana center
An entity licensed by a state agency to sell marijuana and marijuana products pursuant to section 14 of article XVIII of the Colorado Constitution and the Colorado Medical Marijuana Code.
 
Open marijuana container
“A receptacle or marijuana accessory that contains any amount of marijuana and: (I) that is open or has a broken seal; (ii) the contents of which are partially removed; or (iii) there is evidence that marijuana has been consumed within the motor vehicle.” (Colorado Revised Statutes 42-4-1305.5)
 
Openly
Occurring or existing in a manner that is unconcealed, undisguised or obvious.
 
Publicly
Occurring or existing in a public place; or occurring or existing in any outdoor location on private non-residential property where the consumption of marijuana is clearly observable from a public place; or occurring or existing in any outdoor location on private residential property where the consumption of marijuana is clearly observable from a public street, highway or sidewalk.  
 
Public areas
Under the 
Colorado Criminal Code (Colorado Revised Statues Sec 18-1-901) and Denver Revised Municipal Code, the term “public place” is currently defined as, “a place to which the public or a substantial number of the public has access, and includes but is not limited to highways, transportation facilities, schools, places of amusement, parks, playgrounds, and the common areas of public and private buildings or facilities.”
 
Retail marijuana store
“An entity licensed to purchase marijuana from marijuana cultivation facilities and marijuana and marijuana products from marijuana product manufacturing facilities and to sell marijuana and marijuana products to consumers.” (Colo. Const. Art. XVIII, Section 16)
