Minor Revisions to the Land Development Regulations (LDR) are scheduled for the October 2, 2019 Planning Commission and November 12, 2019 City Council Meetings. On November 13, 2018, the City Council approved a complete reorganization of all development-associated regulations into a new Land Development Regulation (LDR).
Staff has been working under the new LDR for the last year. Although the new LDR is a signifigant improvement over the previous development regulations, there have been minor issues that have arisen that should be corrected/clarified. It is very typical and common for a municiaplity to review their regulations and make corrections on an annual basis.
The proposed changes to the LDR include the following:
- Clarify that single family attached (townhouses and rowhouses) that existed before the R-1 zone district was established (November 27, 1995) will be considered conforming.
- Clarify zone districts that allow townhouses and rowhouses. Although they have historically been allowed in R-2 and R-M, it is not explicit that they are.
- Clarify that Accessory Dwelling Units (ADUs) should only be allowed in R-E and R-1 Zone Districtis, and require a minimum size of 200 sf (there is presently no minimum size and 200 sf will require a building permit).
- Change Final Development Plan eligibility to apply to new "buildings" vs. "structures".
- Remove "tourist home" from allowed uses. This has hbeen used as a loophole to avoid meeting the requirements of short term rental,s hotels, and motels.
- Make applicants responsible for stuffing envelopes and sending them via. a certificate of mailing for all purposes that require a mailing. (Presently staff is required to do this and it is very time consuming).
- Require proof of insurance with Short Term Rental Applications.
- Eliminate requirements for boundary surveys with conditional uses and rezonings.

COMMUNITY MEETING SCHEDULED FOR 2800 MINER MULTI FAMILY PROJECT
A Community Meeting has been scheduled for a proposed multi family project at 2800 Miner STreet. 3 Builds are proposed for a total of 69 units. The community meeting is an opportunity for interested parties to be introduced to the project, ask questions, and offer feedback.
The meeting is scheduled for Tuesday November 26 at 6 PM. It will be at City Hall, located at 1711 Miner Street.
