Division of Conservation: HB19-1264 Working Group
On June 3rd Governor Polis signed HB19-1264 into law extending the conservation easement oversight commission and division of conservation program to certify easement holders through June, 2026. Additionally, the bill creates a working group to make policy recommendations to the General Assembly for 1) an alternative method to the current appraisal process for establishing the amount of a conservation easement tax credit; 2) a process to provide retroactive tax credits, payments or refunds to taxpayers whose tax credits were denied in whole or in part from 2000 to 2013 (aggrieved landowners), including development of eligibility criteria; and 3) administration of orphaned easements.
The HB19-1264 Working Group Final Report was submitted to the legislature on November 26, 2019.
