Water quality Notices of Violation and penalties
A Notice of Violation (NOV) is a formal action taken against the owner of a water or wastewater facility for violation of Section 100.18, Regulation 100:
No owner of a water or wastewater facility shall allow the facility to be operated without the direct supervision of an operator in responsible charge certified in a classification equivalent to or higher than the classification of the facility as specified in sections 100.4 through 100.8.
Since 2012, Facility Operator Certification NOVs for operator in responsible charge (ORC) violations are issued in a category separate from our other enforcement actions.
A list of notices issued is available on our enforcement page within the year the action occurred.
A penalty may or may not be assessed with the notice for up to $300 per day per violation.
