Solid Waste proposed rulemakings and stakeholder processes

 
 
Stakeholder process to modify and create regulations due to the passing of Senate Bill 19-198, "Concerning the Continued Management of Waste Tires”
Due to the recent passing of Senate Bill 19-198, the department will hold stakeholder meetings to modify and create regulations within 6 CCR 1007-2, Part 1 - Regulations Pertaining to Solid Waste Sites and Facilities. Some proposed changes include:
  • Add, delete and modify definitions (Section 1.2: Definitions).
  • Propose waste tire fee beginning January 1, 2020 (Section 1.7.6: Solid Waste Authorization and Fees).
  • Change deadline for waste tire facilities annual reports (Sections  10.3, 10.5, 10.6, 10.7, 10.8, and 10.9: Regulations Pertaining to Waste Tire Haulers, Waste Tire Monofills, Waste Tire Processors, Mobile Waste Tire Processors, Waste Tire Collection Facilities, and Waste Tire End Users).
  • New requirement when a Waste Tire Monofill requests a waiver (Section 10.5: Standards for Waste Tire Monofills).
  • Modify rules for retention of documentation for new replacement tire sales  (Section 10.11: Waste Tire Fee Administration).  
  • New section for the administration of the revised End Users Fund (Section 10.12: Waste Tire End Users Fund).
  • New section on the proper end use of Waste Tire Bales (Section 10.13: Standards for End Users of Waste Tire Bales).
Two stakeholder meetings will be held at the Colorado Department of Public Health & Environment at 4300 Cherry Creek Drive South, Denver, CO 80246:

Sections to be reviewed: 1.2, 1.7.6, 10.3, 10.5, 10.6, 10.7, 10.8, 10.9, 10.11
