Regulation 9, Proposed Rulemaking

The Air Pollution Control Division is initiating a stakeholder process to engage stakeholders on potential revisions to the Air Quality Control Commission's Regulation Number 9.
Potential revisions include: 1) Clarifications regarding the fees for users of prescribed fire permits utilizing the division's Smoke Management Program, particularly the section that includes the 3-year block average SMP score; 2) Removal of fire safety language; and 3) Clarification of what can and cannot be burned and why burn barrels are prohibited for users utilizing the division's Open Burning Program.
In February 2020, the Division intends to request that the Commission schedule a rulemaking hearing in May 2020.

The Division will host two stakeholder meetings to discuss the proposed revisions and rulemaking process:
