Gross receipts from retail sales by an auctioneer at his established auction house, sales yard or other place of business are taxable, regardless of how the property may have been acquired or by whom it may be owned and the auctioneer is required to obtain a sales tax license. (DOR Regulation 39-26-102.1)

Most product sales are subject to sales tax. Contact the Department of Revenue regarding sales tax licensing regardless of whether a business sells retail, wholesale, on consignment or at events.

An auctioneer who buys and resells automobiles at auction must be licensed as a motor vehicle dealer.

An auctioneer who sells automobiles owned by individual consumer clients is NOT required to be licensed as a Motor Vehicle Dealer. For laws and regulations, please visit:

An inspection is required every time an animal is sold or purchased (horses, cattle, mules, and donkeys) or when any change of ownership occurs, regardless of whether or not the animal is transported after or prior to the sale. Animal inspection is also required anytime livestock leaves the State, regardless of purchase.
