E X E C U T I V E O R D E R
CONTINUING THE
GOVERNOR'S ADVISORY COUNCIL
FOR PERSONS WITH DISABILITIES
| WHEREAS, | more than 400,000 Coloradans have one or more physical or mental disabilities; and |
| WHEREAS, | the State of Colorado seeks to ensure equality of opportunity, independent living, full participation and economic self-sufficiency for all citizens of the state; and |
| WHEREAS, | the Americans with Disabilities Act of 1990 established new principles and guidelines regarding individuals with disabilities; and |
| WHEREAS, | individuals with disabilities are often subject to discrimination in the areas of telecommunications, public services, public accommodations operated by private entities, and employment. |
NOW THEREFORE, I Roy Romer, Governor of the State of Colorado, pursuant to the
authority vested in me under the statutes and constitution of the State of Colorado, DO
HEREBY ORDER THAT:
| 1. | The Governor's Advisory Council for Persons with Disabilities is hereby continued. There shall be no more than 20 members appointed by the Governor, for terms expiring at the pleasure of the Governor. There shall be at least 7 members from state agencies including at least one representative from each state department serving individuals with disabilities and the remaining members representing persons with disabilities from business and industry and non-profit organizations. The chair shall be appointed by the Governor. Membership on the council shall reflect statewide participation and commitment to the inclusion of persons with disabilities and shall be located under the jurisdiction of the Office of the Governor. |
| 2. | The council shall continue to: |
| a. | facilitate the coordination among all state programs, services and plans established for or related to persons with disabilities; | |
| b. | advise the Governor on legislation and state policy affecting individuals with disabilities in education, employment, transportation, and housing; | |
| c. | issue an annual report to the Governor and the Legislature concerning the state's programs and policies addressing persons with disabilities; | |
| d. | monitor the state's implementation of Title II of the Americans with Disabilities Act of 1990; | |
| e. | act as an additional entry point for public grievances regarding disability issues and referring such grievances to appropriate state personnel or agencies; | |
| f. | meet at least quarterly; | |
| g. | develop an annual fiscal operating plan prior to the initial review date; | |
| h. | perform other duties as assigned to the council by the Governor. |
| 3. | Determine by-laws relating to the internal operations of the council and shall not include authorities not directly granted by this executive order with approval of the Governor's Office |
| 4. | If the council raises money for operating or other expenses, all funding requests must be pre-approved by the Office of the Governor. No funding is available for this council through the Office of the Governor. |
