DECLARING THE COLORADO BUREAU OF INVESTIGATION AS THE POINT OF CONTACT FOR THE NATIONAL INSTANT CRIMINAL BACKGROUND CHECK SYSTEM

WHEREAS, on November 30, 1993, Congress passed the Brady Handgun Violence Prevention Act of 1994; and
WHEREAS, the Colorado General Assembly passed section 12-26.5-101, et seq., C.R.S., implementing the interim provisions of the Brady Act; and
WHEREAS, section 12-26.5-101 et seq., C.R.S., was amended in 1998 to require the Colorado Bureau of Investigation to conduct criminal background checks on persons attempting to purchase any type of firearm from federally licensed firearms dealers, effective November, 30, 1998, when the permanent provisions of federal Brady Act becomes law; and
WHEREAS, such statute requires the Colorado Bureau of Investigation to notify the Revisor of Statutes of the date when the National Instant Criminal Background Check System (NICS) is implemented; and
WHEREAS, there will be a period of transition before the permanent provisions of the Brady Act are fully implemented through the NICS; and
WHEREAS, the Director of the Federal Bureau of Investigation has requested that the states designate respective points of contact for the NICS; and
WHEREAS, it is necessary for the State of Colorado to designate a point of contact for the NICS until the 1999 Colorado General Assembly considers legislation, if any, regarding the state's participation in NICS.

NOW, THEREFORE, I, Roy Romer, Governor of the State of Colorado, under the authority vested in me by the Constitution and the laws of the State of Colorado, do hereby order the following:

1. The Director of the Colorado Bureau of Investigations (Director) will act as the point of contact between the State of Colorado and the Federal Bureau of Investigation for the National Instant Criminal Background Check System.

2. The Director will assess the progress of the implementation of the National Instant Criminal Background Check System.

3. The Director will notify the Governor, the General Assembly and the Revisor of Statutes of the date when the National Instant Criminal Background Check System is fully implemented.
