E X E C U T I V E O R D E R

CONTINUING THE STATE OF EMERGENCY DUE TO THE MURDER AND
INJURY OF LAW ENFORCEMENT OFFICERS AND ROLLING FORWARD THE
DISASTER EMERGENCY FUND BALANCE

WHEREAS, Executive Order D010 98, dated June 2, 1998, declaring a state of emergency, which was extended by Executive Order D011 98, dated June 8, 1998, and Executive Order D012 98, dated June 10, 1998, was issued to provide Colorado National Guard assistance to the search efforts for the three heavily armed men who shot and killed a Cortez police officer and wounded other officers; and

WHEREAS, two of the men remain at large and various search, response and mitigation efforts are continuing; and

WHEREAS, there is a continuing need to provide support to the Montezuma County Sheriff and other law enforcement authorities to apprehend these suspects; and

WHEREAS, the Colorado Disaster Emergency Fund is available to meet the needs of a disaster emergency if the funds regularly appropriated to state and local agencies are not sufficient; and

WHEREAS, the remaining balance of the Disaster Emergency Fund is scheduled to revert to the general fund at the end of the previous fiscal year ending June 30, 1998, unless these funds are rolled forward to the next fiscal year by executive order; and

WHEREAS, there is a continuing need for the funds remaining in the Disaster Emergency Fund to meet the needs of this disaster emergency and previous disaster emergencies which occurred in fiscal year 1997-98.

NOW, THEREFORE, I, Roy Romer, Governor of the State of Colorado, under the authority vested in me by the Constitution and laws of the State of Colorado, including Sections 24-32-2104 and 28-3-104, C.R.S., do hereby order the following:

  1. Executive Orders D010 98, D011 98 and D012 98 are hereby continued in effect for fifteen (15) days following the issuance of this Executive Order unless otherwise extended.
  2. The balance remaining in the Disaster Emergency Fund as of June 30, 1998, shall be rolled forward for the duration of fiscal year 1998-99 beginning on July 1, 1998.
