E X E C U T I V E O R D E R

DECLARING A STATE OF EMERGENCY AND ORDERING TO STATE ACTIVE
DUTY PART OF THE COLORADO NATIONAL GUARD

WHEREAS, a wildfire broke out on Mount Evans, Colorado on June 27, 1998; and

WHEREAS, homes in the area are threatened; and

WHEREAS, the wildfire quickly increased from a few acres to over 300 acres; and

WHEREAS, numerous fire fighters were involved in fighting the fires and it became obvious that Colorado National Guard resources were needed to assist in preventing the spread of the fire; and

WHEREAS, a Memorandum of Understanding exists between the U.S. Forest Service and the State of Colorado for use of National Guard resources in circumstances such as these without cost to the State of Colorado; and

WHEREAS, the U.S. Forest Service provided proper and adequate justification for the request as required by the Memorandum of Understanding and has agreed to pay all costs resulting from the use of the National Guard; and

WHEREAS, this justification and the recitals above were verified to me by the Adjutant General of Colorado.

NOW, THEREFORE, I, Roy Romer, Governor of the State of Colorado, under the authority vested in me under Section 24-32-2104, C.R.S., of the Colorado Disaster Emergency Act of 1992, do hereby proclaim that a state of disaster emergency exists for the reasons set forth above, and confirm my verbal orders issued on June 29, 1998, that under the provisions of 28-3-104, C.R.S., the Adjutant General of Colorado order to State Active Duty, without pay, volunteer personnel of the Colorado National Guard in accordance with the provisions of the Memorandum of Understanding between the U.S.

Forest Service and the State of Colorado for a period not to exceed fifteen (15) days to respond to wildfire problems within the State of Colorado. The Adjutant General shall determine the number of individuals assigned to this duty and identify equipment deployed in this matter.

This Executive Order shall expire after fifteen (15) days, unless otherwise extended.
