E X E C U T I V E O R D E R

DECLARING A STATE OF EMERGENCY
DUE TO THE MURDER AND INJURY OF LAW ENFORCEMENT OFFICERS

WHEREAS, three heavily armed, camouflaged-clad men shot and killed a Cortez police officer; and

WHEREAS, two sheriff's deputies were wounded; and

WHEREAS, expeditious apprehension of the suspects is necessary to preclude additional injury, loss of life, or property damage in the best interests of the citizens of Colorado; and

WHEREAS, local governmental jurisdictions have requested assistance in the search for the heavily armed men; and

WHEREAS, local governmental jurisdictions do not have adequate resources nor aircraft sufficient to search the extended area; and

WHEREAS, the Colorado Army National Guard has available appropriate staff and aircraft that are capable of accomplishing the search requirements that are needed; and

WHEREAS, this justification and the recitals above were verified to me by the Colorado Department of Local Affairs; and

WHEREAS, on May 30, 1998, I verbally declared a state of emergency as a result of the killing of the Cortez police office and the other sheriff's deputies who were injured; and

WHEREAS, the Colorado General Assembly is not in session; and
WHEREAS, pursuant to Section 24-32-2106, C.R.S., the Governor may make funds available form the state Disaster Emergency Fund and may transfer and expend funds appropriated for other purposes to meet the needs of the disaster emergency if the funds regularly appropriated to state and local agencies are not sufficient; and Due to the Murder and Injury of Law Enforcement Officers

WHEREAS, the Governor's Disaster Emergency Council concurs with the findings and actions set forth in this Executive Order; and /td>

WHEREAS, the conditions under which funds can be made available and used to meet the needs of a disaster emergency have been satisfied as a result of the occurrence and imminent threat of emergency described herein.

NOW, THEREFORE, I, Roy Romer, Governor of the State of Colorado, under the authority vested in me by the Constitution and laws of the State of Colorado, including Sections 24-32-2104 and 28-3-104, C.R.S., do hereby confirm my verbal order issued May 30, 1998, that a state of emergency existed in Southern Colorado due to the reasons set forth above. I hereby further order that:

  1. The Adjutant General, or such other officers of the National Guard as may be appropriate, are authorized and approved to order to State Active Duty as many members of the Colorado National Guard as necessary for the purposes of response and mitigation of this emergency, as well as other directly related, required, and appropriate missions.

  2. The use of Colorado National Guard helicopters is authorized on state mission orders for the purposes of response to and mitigation of this emergency, as well as other directly related, required, and appropriate missions.

  3. The Adjutant General or other such National Guard officers as may be appropriate shall determine the number of such members and helicopters to be used, in consultation with the Colorado Department of Local Affairs.

  4. This Executive Order shall expire on June 7, 1998, unless otherwise extended.
