E X E C U T I V E O R D E R
ESTABLISHING A SUB-UNIT WITHIN THE DEPARTMENT OF REVENUE, MOTOR VEHICLE DIVISION, DEALER SECTION INVESTIGATIONS UNIT, FOR THE ADMINISTRATION OF CRIMINAL JUSTICE
| WHEREAS, | pursuant to C.R.S. 12-6-105(I)(d)(I) the Executive Director of the Department of Revenue is required to investigate complaints and suspected or alleged violations by persons licensed by the Executive Director and the Motor Vehicle Dealer Board; and |
| WHEREAS, | pursuant to C.R.S. 12-6-105(l)(d)(II) the investigators employed by the Executive Director of the Department of Revenue have the authority to issue summonses and to procure criminal records during an investigation; and |
| WHEREAS, | pursuant to C.R.S. 12-6-118(6) any license issued hereunder by the Motor Vehicle Dealer Board or by the Executive Director may be denied, suspended or revoked if unfitness of such licensee or applicant is shown in the criminal character or record of the license or applicant: |
NOW, THEREFORE, I Roy Romer, Governor of the State of Colorado, by the power vested in
me by the Constitution and the laws of the State of Colorado, do hereby establish a
sub-unit within the Department of Revenue, Motor Vehicle Division, Dealer Section
Investigations Unit, the principal purpose of which shall be the administration of
criminal justice as defined by 28 C.F.R. 20.3(C)(2)(d).
I FURTHER ORDER that a substantial part of the annual budget of the Dealer Section Investigations Unit be allocated to the administration of criminal justice.
