Discontinuation of Services
In-Home Support Services
- An IHSS Agency may discontinue IHSS services to an Eligible Consumer when the Eligible Consumer, the IHSS Agency or the Case Manager has secured other equivalent care in the community.
- An IHSS Agency may discontinue IHSS services to an Eligible Consumer when the Eligible Consumer exhibits inappropriate behavior toward Attendants. Inappropriate behavior includes documented verbal, sexual and/or physical abuse. Verbal abuse is defined as consistent verbal threats, insults or extremely rude language from the Eligible Consumer to the Attendant over a period of time.
- An IHSS Agency cannot discontinue services to an Eligible Consumer unless documented efforts have been made to resolve the situation that triggers such discontinuation. Efforts to resolve the situation include, but are not limited to, providing independent living skills training, mediation, revising the IHSS Plan, changing or appointing an Authorized Representative or changing the Attendant.
- The IHSS Agency must provide 30 days advanced written notice that the inability to maintain a relationship with an Attendant or the Eligible Consumers behavior will result in discontinuance of services.
- The Eligible Consumer will have 30 days to correct the problem and the IHSS Agency staff shall work with the Eligible Consumer to address and modify the behavior during the 30-day warning period.
- An Eligible Consumer cannot be discontinued until other equivalent community care has been established. Dumping or abandonment by an IHSS Agency is prohibited.
- Eligible Consumers can discontinue services at any time.
