Law Enforcement Officers Safety Act of 2004

House Resolution 218, the Law Enforcement Officers Safety Act (LEOSA), was enacted July 22, 2004 as Pub. L. 108-277, and is codified as 18 U.S. Code §926B and §926C.

The Act permits the nationwide carrying of concealed handguns by qualified current and retired law enforcement officers and amends the Gun Control Act of 1968 (Pub. L. 90-618, 82 Stat. 1213) to exempt qualified current and retired law enforcement officers from state and local laws prohibiting the carry of concealed firearms.

The following guidelines and definitions are contained in the Act. All persons desiring to participate in this program must meet all of the following criteria as specified in the Act.

Section 926 C of the LEOSA, defines qualified retired law enforcement officers as:

• A person retired in good standing from service with a public agency, other than for reason of mental instability.

• Before such retirement, such person was authorized to engage in the prevention, detection, and prosecution and had powers of arrest.

• Before such retirement, such person was regularly employed for and aggregate of fifteen years of commissioned service, or more, or;

• Retired from the agency after completing the probation period due to a service connected disability as determined by the agency.

• Has a non-forfeit-able right to benefits under a retirement plan

• Has met the state standard for training and qualification for active law enforcement officers to carry firearms within the most recent twelve month period.

The retired commissioned officer must complete the following two forms prior to the firearms qualification and forward to:

• Retired Commissioned Officers Firearms Training Program Application (CSP 31)
• Colorado State Patrol Retired Officers Medical Release (CSP 31B)

After the Academy Range Master has processed the application and medical waiver, notification will be made to the local Troop Range Officer advising them that the applicant successfully meets all LEOSA requirements.

Troop Range officers will then schedule a date for the retired commissioned officer to complete the firearms qualification.
