Comprehensive Sentencing Task Force

The Comprehensive Sentencing Task Force was seated by CCJJ September 2010 to conduct a comprehensive and thorough analysis and assessment of sentencing schemes in Colorado from the point of conviction through parole discharge. Sentencing statutes are examined by crime category with the exception of some categories that are addressed by other Commission task forces (for example, juvenile justice). This task force was also seated pursuant to Senate Bill 2009-286 and followed the previously seated Sentencing Task Force that existed from August 2009 to April 2010. Unless otherwise noted, all meetings of the Comprehensive Sentencing Task Force will be held at the 710 Kipling Street, Lakewood, Colorado from 1:30pm-5pm.

To ensure balanced representation on the Comprehensive Sentencing Task Force, the CCJJ Chair and Vice-Chair employed a template to guide the appointment process. Representative agencies and stakeholders were determined first, followed by the appointment of volunteers to the available positions. Current members of the Commission ("CCJJ") serving on the task force are listed first, followed by the remaining task force members in alphabetical order.

The Comprehensive Sentencing Task Force has created the following work groups. The groups may be engaged simultaneously or intermittently in meetings and activities as the need for work on these topics arises. Check the CCJJ Master Meeting Calendar for any scheduled meetings of these working groups.

ONGOING
Extraordinary Risk Working Group
This work focuses on reducing the statute complexity regrarding sentence enhancements. The group identifies issues and develops recommendations for the task force.

Sex Offense Working Group (Charter)
This group studies issues regarding sex offenses. Areas of study may include indeterminate and determinate sentencing of sex offenses, lifetime supervision, and the impact of any changes on the availability of sex offender treatment in the Department of Corrections and in the community.

Value-Based (Crimes) Working Group
This group expands previous work to consolidate theft crimes (carried out during FY 2013).   The focus is other non-violent, value-based (property) crimes, representing such acts as check fraud, arson, I.D. theft, computer hacking, credit card fraud, and property damage to name a few.

Non-Value-Based (Crimes) Working Group
This group expands previous work to consolidate theft crimes (carried out during FY 2013). The focus is other non-violent, non-value-based (property) crimes.  In other words, this group is addressing those property-based crimes not included among those under review by the Value-Based Working Group.

HIATUS
Habitual / Mandatory Minimum Working Group
This work focuses on improving sentencing statutes in this area.  The topic will be addressed with extensive outreach to experts and to representatives of a variety of constituencies and stakeholders. The group identifies issues and develops recommendations for the task force.

Parole Working Group
This work focuses on the role that parole plays in sentencing. The group would identify issues and develop strategies.

CONCLUDED
Classification Working Group
This group focused on revamping the classifications for theft and adding categories for F5, F6 and M1 crimes.

Consolidation Working Group
Combined with the work of the Classification Working Group, the goals were to reduce the number of ‘Christmas tree’ crimes and roll them into a new theft scheme (that includes F5’s, F6’s and M1’s). This work was done under a new classification scheme.

Statewide Diversion Working Group
This group investigated a statewide Diversion program. One issue of importance is whether such programs can be partially funded by offenders.
