Financial Responsibilities Act
If you were in an accident and did not have insurance in effect, you may be subjected to what is known as a Financial Responsibilities Act (FRA) Suspension. If this action is taken against your driving privileges, the DMV will send you a letter regarding this and you may request a hearing on the matter. The Hearing Officer will be looking to gather information on the following questions:
- Did you have proof of insurance for the date and time of the accident?
- If not, were you responsible for damages to anyone else?
If the hearing officer determines you did not have insurance in effect and you were responsible for damages to someone else, you license will go under suspension. In order to get reinstated, at a minimum you will need to show one of the following four items:
- Show proof that a lawsuit was filed and the court found you were not responsible,
- Show proof that you have been release from liability by the damaged part(ies),
- Show proof you have posted a sufficient bond, or
- It has been more than 3 years since the accident and no lawsuit has been filed.
There are no driving privileges that can be granted by the Hearings Division for this type of action.
