REQUIREMENTS

Off Premise Permits are governed by the following Laws & Regulations:

12-6-102 (16)(2), Regulation

C.R.S. 12-6-102 (16)

1. A motor vehicle dealer or used motor vehicle dealer shall obtain an off-premise permit to:

• Offer;
• Display;
• and sell

motor vehicles away from the dealer's place of business.

A request for an off-premise permit shall be made in writing prior to the event and shall list the location and the date(s) of the sale.

The permit shall be posted for inspection at the sale.

2. No off-premise sale shall exceed six days except for the:

• National Western Stock Show
• Colorado State Fair
• Metro Denver Auto Dealers Association Annual Denver Auto Show

which shall not exceed twenty days.

Consecutive permits for the same location are not allowed.

C.R.S. 12-6-302. Sunday closing

No person, firm, or corporation, whether owner, proprietor, agent, or employee, shall keep open, operate, or assist in keeping open or operating any place or premises or residences, whether open or closed, for the purpose of selling, bartering, or exchanging or offering for sale, barter, or exchange any motor vehicle, whether new, used, or secondhand, on the first day of the week commonly called Sunday. This part 3 shall not apply to the opening of an establishment or place of business on the said first day of the week for other purposes, such as the sale of petroleum products, tires, or automobile accessories, or for the purpose of operating and conducting a motor vehicle repair shop, or for the purpose of supplying such services as towing or wrecking. The provisions of this part 3 shall not apply to the opening of an establishment or place of business on the said first day of the week for the purpose of selling, bartering, or exchanging or offering for sale, barter, or exchange any boat, boat trailer, snowmobile, or snowmobile trailer.

FORMS REQUIRED

DR 2043 – Off-Premise Permit Application –  If copies are being provided, the applicant shall provide 1 original and 3 copies.

• Any date falling on a Sunday subjects the applicant to the provisions of the Sunday closing law as stated above. This permit should NOT be construed as permitting Sunday sales in violation of that law.
• Approved permits will be mailed to the Dealership, or if presented in person, may be approved at the Auto Industry Division counter located at 1881 Pierce St. #112, Lakewood, CO 80214
• Once permit is approved, the approved permit must be posted for inspection at the sale location.
• The form must be signed by an: Owner, Partner, LLC Member/Manager, or Corporate Officer (president, vice president, secretary or treasurer). The title of the person signing the form must be provided and form must be dated.
• Failure to complete all sections of the application may result in a rejection or delay in processing.

FREQUENTLY ASKED QUESTIONS

Dealers

Can a Dealer get a Monday through Saturday permit this week and another one for Monday through Saturday next week?

• No, that would be consecutive permits, even though Sunday breaks the two events. 

Can a Dealer purchase only one permit to cover a Wednesday through Tuesday show?
 

• Yes. In this case, the permit is within the six-day limit, so it can be approved, but the Dealer can only display the vehicles on Sunday – NO SELLING.

Are the requirements different for “Out of State” Dealers who wants to sell motor vehicles in Colorado at one of the upcoming Colorado events?

• Out of State Motor Vehicle Dealers should see 12-6-108.5(2) for out of state requirements. Powersports Dealers should see 12-6-509(2).

Manufacturers

Can I sell or display my manufactured motor vehicles in Colorado at one of the upcoming Colorado events?

• Yes, if you are currently licensed as a Colorado Manufacturer and have an existing franchise agreement with a Colorado franchised Dealer. The Dealer must obtain the Off Premise Permit.
