PRE-LICENSING EDUCATION PROGRAM PROVIDERS

 

TOPIC: Pre-licensing Education Program Provider Applications

 

On August 5, 2008, Colorado Senate Bill 08-151 (SB 08-151) takes effect to establish a new educational requirement in connection with specific types of licenses for which a person submits an application on or after September 4, 2008.

 

SB 08-151 establishes a Pre-licensing Education Program (the Program), requiring 8 hours of instruction through one or another approved private educational provider. The Motor Vehicle Dealer Board (the Board) has established emergency rules (the Rules) that go into effect on August 5, 2008, in order to meet the Legislatures September 4, 2008 deadline.

 

How does a prospective Pre-licensing Education Program Provider apply for and obtain approval to offer the Program to license applicants?

 

Neither the Rules nor SB 08-151 restricts the number of entities that can provide the Program to license applicants. Colorado State procurement rules do not apply to the Program-provider selection process, and the State will not enter into a contract with a Program-provider. The State is not responsible to fund the Program. Instead, License applicants will register with a Provider, pay the Provider for their participation in the Program, complete the 8-hour classroom instruction in the Providers Program, and, if successful, receive the Certificate of successful completion to submit to the Board prior to obtaining their licenses.

 

The Rules enable private educational providers to apply to the Board for approval to provide the Program to relevant license applicants. The Rules permit the Boards Executive Secretary, pursuant to the Rules and SB 08-151s requirements, to review the educational providers applications, including their particular Program curriculum and materials, and either to approve or to deny an application. As soon as the Executive Secretary has approved a Providers application, the Providers name and other relevant information will be posted on the Boards internet pages.
