Notice of Potential Contract Amendment

In accordance with the provisions of §24-37.5-105(10) C.R.S., the Office of Information Technology (OIT) has made a preliminary determination that the state would benefit from the negotiation of amendments to the following contracts (Contract numbers #89-13 and #COFRS 1-91). OIT anticipates making a final determination whether or not to amend the contracts on July 20, 2012.


An amendment will be for the purchase of a vendor hosted and managed government Enterprise Resource Planning (ERP) solution including a public-private partnership financing option. A copy of the original contracts may be viewed or downloaded at: BIDS Solicitation Number RFI-005-TK-12.


Parties to the existing contracts: DPA and OSA


OIT is evaluating potential amendments to (check all that apply):


X Expand the scope to include additional state agencies
X Extend the term of the contract
X Improve cyber security
X Other: To upgrade or replace the existing state financial management system as applicable to update the current technology, improve the functionality of the system and migrate into a vendor managed and hosted Government Enterprise Resource Planning solution.


In addition, OIT will consult and negotiate with the existing contractor(s) to obtain terms and conditions more favorable to the state. (§24-37.5-105(10)(f) C.R.S.)


OIT will consider written comments and/or confer with any provider that notifies the Office of its interest and reasonable assertion that it is able to provide the goods/services to be negotiated under this amendment in a manner more favorable to the state. The sole purpose of these discussions will be to assist OIT in determining whether or not to amend the existing contracts. Discussions cannot result in unilateral cancellation of the existing contract or in the direct award of a new contract. (§24-37.5-105(e); §24-37.5-105(10)(k) C.R.S.)  Any provider that wishes to provide written comments or consult with OIT regarding this contract must notify OIT as set forth below:

Your notice to the above person must include your name, company name, address, phone, and email address. Include a brief written statement supporting your assertion that you are able to provide the goods/services to be negotiated under this amendment in a manner more favorable to the state.


Incomplete information, or notice to someone other than the individual listed here may result in your being omitted from the consultation process.


Notice MUST be received by 5:00 p.m. July 15, 2012.


Written comments must be received and discussions MUST be scheduled and completed prior to: July 20, 2012.
