Documents and Research

The Department has issued several letters to the Centers for Medicare and Medicaid Services (CMS) requesting clarification on their policies and to allow the Department more flexibility in claiming federal financial participation for this population.  Until CMS responds to these letters, the Department will not issue policies regarding these topics.  CMS has not provided a response to the following items:

  • November 6, 2009 letter, Re:  Individuals Residing in Colorado Community Corrections Facilities are Eligible for Health Care Services Funded with Federal Financial Participation.

     

  • May 29, 2009 letter, Re:  Suspension of Medicaid Eligibility for Incarcerated Persons (contains a proposed policy to suspend an inmate's Medicaid eligibility).

Proposed Policy Concerning Community Corrections  -  August 2009

The Department has prepared a proposed policy concerning funding of health care services for those in Community Corrections and is seeking input from CMS. 

In addition, the Department requested that stakeholders provide comments on the proposed policy.  All stakeholder input was collected in August 2009.
