Department Function:

The Clerk and Recorder's Office is responsible for issuing liquor licenses to qualified applicants pursuant to the Liquor and Beer Codes and Regulations of the Colorado Department of Revenue.
 

Applying for a Liquor License

  1. Call the County Clerk and Recorder's Office to schedule an appointment as our office only has two employees that can assist you with your application.
  2. At your appointment, you will receive several forms to take home and complete. It will depend on the type of license as to which forms you will need to fill out. Two of the forms that you will have to complete will be the standard application, and the individual history record. Also, all applicants will be finger printed and a criminal history check will be conducted with the Colorado Bureau of Investigation.
  3. Schedule another appointment to return the forms, fees and any additional paperwork that you may have been asked to obtain. Please bring two copies of everything that we asked you to bring. Also, we suggest that you make a copy for yourself since there will be a copy fee if we make your copy for you. At this appointment we will schedule a public hearing in the Commissioners Office. The hearing must be scheduled at least 30 days after our office receives the completed application and paperwork pertinent to the license.
  4. You must post the sign advertising the hearing in a conspicuous place on the premises for which the application has been made for at least 10 days prior to the hearing. Our office provides the sign. Two pictures of this sign will be needed (one on the 1st day and one on the 10th day of the posting.) Please bring these pictures with you to your public hearing.
  5. Appear before the Moffat County Board of Commissioners on the scheduled date.

 

If the Board of County Commissioners determines there is a need for this type of establishment and approve your application, our office will forward it to the State for issuance of a liquor license. It will take approximately 30 days to process if the application is in order.

Transfer of Ownership

If you are purchasing an establishment that already has a current liquor license in place then you should apply for a transfer of ownership. If applying for a Transfer of Ownership, only follow steps 1-3 above. You will still need to pay both the administrative fees and the licensing fees. It will take approximately 30 days to process your application with the County and the State.

 

Fees

Both the County and the State collect liquor license fees. The fees differ according to the type of license that you are applying for. One check will be made payable to Moffat County and one check payable to Colorado Department of Revenue. At the time of application for a new establishment or a change of ownership, both administrative and license fee are due. However, only license fees are due at time of renewal. Fingerprinting

Fingerprints are taken at the Moffat County Sheriff's Office at 800 W. 1st Street, Ste. 100, Craig, Colorado 81625. Please let the Sheriff's Office know that you are being fingerprinted for a liquor license. After being fingerprinted, please bring the fingerprint card and a check for $38.00 made payable to the Colorado Bureau of Investigation. Definitions of Colorado Retail Liquor and Beer Licenses and Permits

 

Retail Liquor Store license shall be issued to persons selling only malt, vinous, and spirituous liquors in sealed containers not to be consumed at the place where sold.

 

Liquor-Licensed Drug Store license shall be issued to persons selling malt, vinous, and spirituous liquors in sealed containers not to be consumed at the place where sold.

 

Beer and Wine license shall be issued to persons selling malt and vinous liquors for consumption on the premises, and such licensees shall have available for consumption on the premises during business hours sandwiches and light snacks, but need not have meals available for consumption.

 

Bed and Breakfast license may be issued to a person operating a bed and breakfast with not more than twenty sleeping rooms and offers complimentary malt, vinous, or spirituous liquors for consumption only on the premises and only by overnight guests.

 

Hotel and Restaurant license shall be issued to persons selling malt, vinous, and spirituous liquors in the place where such liquors are to be consumed.

 

Tavern license shall be issued to persons selling malt, vinous, or spirituous liquors by the drink only to customers for consumption on the premises, and such licensee shall have sandwiches and light snacks available.

 

Optional Premises license shall be granted when approved by the state and local licensing authorities to persons selling malt, vinous, and spirituous liquors by the drink only to customers for consumption on the optional premises.

 

Brew Pub license may be issued to person operating a brew pub and also selling malt, vinous, and spirituous liquors to be consumed on the premises.

 

Club license shall be issued to persons selling malt, vinous, and spirituous liquors by the drink and only to members and their guests for consumption on the premises.

 

Arts license may be issued to any nonprofit arts organization that sponsors and presents productions or performances of an artistic or cultural nature. It shall permit the licensee to sell malt, vinous, and spirituous liquors only to patrons of such productions on the premises in connection with such productions and performances.

 

Racetrack license may sell malt, vinous, and spirituous liquors by the drink for consumption on the licensed premises only to customers of such racetrack and shall serve food as well as such liquors.

 

Public Transportation System license shall be issued by the state licensing authority to persons operating a public transportation system selling any malt, vinous, or spirituous liquors by the drink to be served and consumed in or upon any dining, club, or parlor car; plane; bus; or other conveyance of such public transportation system.

 

3.2% Beer license shall be issued to persons selling fermented malt beverage (3.2% beer) to the public by the drink for consumption on the premises, or in sealed containers for off-premises consumption, or for both on and off-premises consumption, depending upon the type of license issued.

 

Mini Bar Permit allows a hotel and restaurant license owner who has a separate hotel facility, if located within 1000 feet of its existing hotel and restaurant license, to establish a mini bar in guest rooms at the hotel.

 

Delivery Permit allows the delivery of 3.2% beer or other alcoholic beverages by establishments licensed to sell 3.2% beer or other alcoholic beverages in sealed containers.

 

Wholesaler's license shall be issued to persons selling vinous or spirituous liquors at wholesale.
