The Colorado General Assembly passed legislation in 2010 (HB 10-1018) concerning the cleanup of illegally disposed waste tires. The program is designed to provide grants for the removal of waste tires that have been disposed of, and to encourage recycling and reuse of these waste tires. Grant funds can be used to pay for the removal, recycling and transport of waste tires to a state or county approved storage, disposal or recycling facility.
The Cleanup Program will provide funds to counties and municipalities for expenditures associated with removing disposed or stored waste tires.
The funds must be used solely for the removal of waste tires from any site deemed illegal by local or state law within counties and municipalities, and for disposal or recycling of the removed tires at a state- or county-approved storage, disposal or recycling facility.
Counties and municipalities receiving grant awards are authorized to conduct the clean-up work by using county or municipal personnel, or contract with private entities or other governmental agencies. In awarding contracts for these services, counties and municipalities may give preferential bidding treatment to individuals or entities that will recycle and reuse, rather than dispose of waste tires in a permitted landfill. The Colorado General Assembly specifically declared that it is the policy of the State of Colorado to pursue proposals for recycling and making other beneficial use of waste tires, in lieu of storage or landfill disposal, whenever feasible. The Department of Public Health & Environment may authorize the disposal of whole waste tires in a licensed facility only in the event recycling or reuse of waste tires is not economically feasible.
Grants are awarded based on the following criteria:
Demonstration that the proposed project(s) addresses tires which are illegally disposed or stored;
Per HB 10-1018, the department shall create a priority abatement list of waste tire sites in the state. Illegal waste tire sites identified by submittal of an application will be ranked along with sites on the abatement list to determine the most appropriate use of the grant waste tire cleanup funds.
The Division of Environmental Health & Sustainability staff will review applications on a continuous basis. Funding is awarded based on consistency with program criteria and availability of program revenues. Applicants are encouraged to contact staff for technical assistance in preparing and submitting a grant application.
Funded projects will be reimbursed on a MONTHLY basis for expenses incurred the previous month. Reimbursement requests must include backup documentation of payment such as receipts or invoices marked “PAID” or with zero balances. The state will not reimburse any cost incurred by the applicant prior to the issuance of a legally executed contract, task order, or authorized purchase order. CDPHE reserves the right to withhold 10% of the grant award amount payment until the final report is completed and reviewed by staff. No exceptions will be made to this process.
Grantees are required to submit monthly status reports on the progress of the project along with copies of weight tickets, receipts and reimbursement documentation. A final report is required 30 days after the end of the contract summarizing the project and final waste tire numbers. Information on these reports will be used for annual reporting requirements to the Colorado Legislature. Final reimbursement will not be issued until final report is submitted and approved by the department.

Illegal Waste Tire Cleanup Application – Required questions are outlined in RED. The completed application along with any supporting documents (as outlined on the appendix page) is required prior to review and approval.
All projects must be completed by the end of the fiscal year (June 30th). There is not a deadline for submitting an application.
Electronic applications are strongly preferred. The cover page and full application, including any appendices, must be contained in a single file and must be in PDF (read-only) format.
