Permit Application and Air Pollutant Emission Notice (APEN) Forms


Notice

As of January 1, 2014, the Colorado Air Pollution Control Division no longer accepts blank APENs. Additional fees will apply if an APEN is submitted without the necessary information. An application with missing information may result in longer processing times.  Please note that all APEN submissions should be completed using forms currently supplied by the Division (see Reg. 3, Part A, Section II.A).  If you need assistance, please refer to:

 


 

A Notice of Start-Up must be submitted to the Division no later than 15 days after commencement of operation of the emissions source. Therefore, if you wish to begin operating a source upon receipt of the Initial Approval Permit, please plan ahead and submit a Notice of Start-Up along with your initial permit application.

 

The General Air Pollutant Emission Notice (APEN) is a generic form used to obtain an air permit for a new source of air emissions, to modify an existing air permit, to request an administrative amendment to an existing air permit, or to complete a routine (5-year) Air Pollutant Emission Notice (APEN) renewal even when there is no change to an existing permit. When a "Specialty Air Pollutant Emission Notice (APEN)" exists for a given source, the Specialty Air Pollutant Emission Notice (APEN) should be used in lieu of the General Air Pollutant Emission Notice (APEN). Specialty Air Pollutant Emission Notices (APENs) are listed lower on this page.

 

 

This Air Pollutant Emission Notice (APEN) Addendum must be submitted along with the appropriate General or Specialty Air Pollutant Emission Notice (APEN) to report all Non-Criteria Reportable Pollutants / Hazardous Air Pollutants (HAPs) as defined in Regulation 3. Please complete all applicable information on the form.

 

Within 180 days of being issued an Initial Approval Permit, sources (with the exception of Land Development activities) must certify compliance with the permit requirements in order to receive a Final Approval Permit. After 180 days, the Division must finalize the permit, determine to continue the permit, or cancel or revoke the permit.

Specialty APENs

Where a Specialty Air Pollutant Emission Notice (APEN) exists for a given source, as shown below, the Specialty Air Pollutant Emission Notice (APEN) form should be used in lieu of the General Air Pollutant Emission Notice (APEN) described above. Specialty Air Pollutant Emission Notices (APENs) are designed to report detailed, source-specific information.

    • This notice must be received by the Division at least ten (10) days prior to relocating an Air Curtain Device.
    • Notify the Air Pollution Control Division if Air Curtain Device is Relocated to another section or more than four miles within a county or relocated to a different county than permitted.

Submit this specialty Air Pollution Emission Notices (APEN) to report emissions from hydrocarbon liquid loading operations such as liquid load out from above ground storage tanks and liquid load out from pressurized storage tanks (if reportable). Please note, form APCD-200, the "General Air Pollution Emission Notices (APEN)" will no longer be accepted for reporting emissions from hydrocarbon liquid loading operations.

 

 

Submit this Specialty Air Pollution Emission Notices (APEN) to report land developments (such as construction sites for housing developments, office parks, or pipeline projects); request permit modifications; or report changes in emissions. This form may also be used for various other activities involving excavation, grading, paving, etc. Do not use this form for sources that will operate for an indefinite period of time. It is not necessary to submit the form if the project is less than 25 acres AND less than 6 months in duration. Please complete all applicable information on the form.

Submit this form along with the General or Specialty Air Pollutant Emission Notice (APEN) to report new or modified above-ground storage tanks (ASTs). This form is not required for underground storage tanks located at service stations or condensate tanks. Use one form per storage tank. Please complete all applicable information on the form.

 

Submit this form with the General or Specialty Air Pollutant Emission Notice (APEN) to report any control device used to reduce emissions. Use one form per control device. Please complete all applicable information on the form.
