Precedential Decisions

Regulation 11.2.16.1, 7 Code Colo. Reg. 1101-2 permits the Industrial Claim Appeals Panel upon unanimous vote to designate certain decisions as precedential, to be followed by the hearing officers and deputies of the Colorado Department of Labor and Employment, Division of Employment and Training. Decisions designated as precedential must either interpret a statute, rule, or regulation, or resolve an apparent conflict of authority.

Precedential decisions are to be published and made available to the public. However, section 8-72-107(1), C.R.S. restricts the dissemination of identifying information to the parties in a particular case, public employees in the performance of their public duties, and other specified agents. Therefore, identifying information has been removed from the published decisions contained in this site, and decisions are identified only by docket number.
